по дисциплине «Профессиональный английский язык»

Методические рекомендации по изучению дисциплины

Основные виду занятий – практические занятия. В соответствии с требованиями ФГОС ВПО реализация компетентностного подхода предусматривает широкое использование в учебном процессе активных и интерактивных форм проведения занятий.

При реализации активных методик студент вступает в диалог с преподавателем, выполняет творческие, проблемные задания.

При реализации интерактивных методик осуществляется совместное проблемное обучение через действие. При этом студенты вступают в диалог и с преподавателем, и друг с другом, работают в команде, преподаватель помогает им как организатор комментатор их действий.

В практике организации образовательного процесса по дисциплине « Профессиональный английский язык» применяются следующие интерактивные методики:

1. творческие задания

2. ролевые игры

3. круглый стол

4. интерактивное выступление в т.ч. с использованием приема «студент в роли преподавателя», «студент в роли переводчика».

5. дискуссия

6. дебаты.

7. составление резюме в письменном виде.

Студенту, обучающемуся в магистратуре, необходимо внимательно подойти к выбору оригинальной литературы по специальности, поскольку основным требованием на экзамене по сдаче кандидатского минимума, который имеют право сдавать студенты, обучающиеся в магистратуре по окончании курса обучения, является чтение большого количества (200 стр.) оригинального текста и подготовка письменного перевода части этого материала (10стр.), а также составление словаря-минимума ( не менее 100слов и выражений). Таким образом, издание, выбранное для чтения, должно быть достаточно объемным.

Чтение должно быть внимательным, аналитическим, для пополнения словарного запаса студент должен постоянно обращаться к словарям – общему и по специальности, заучивать слова. Необходимо совершенствовать, расширять и тренировать знания и умения в области фонетики, лексики и грамматики на базе читаемых текстов, стараться обращать внимание на грамматические конструкции, знакомые и незнакомые, стараться фонетически правильно читать незнакомые слова, для чего следует постоянно обращаться к словарю, тем самым выполняя и лексическую задачу – заучивание словарного запаса.

В качестве форм контроля понимания прочитанного и воспроизведения информативного содержания текста – источника используются ответы на вопросы, подробный или обобщенный пересказ прочитанного, постановка вопросов по тексту самим учащимся, передача содержания в виде краткого перевода, полного перевода, аннотации или резюме.

Следует уделять внимание тренировке в скорости чтения: свободному беглому чтению вслух и быстрому чтению про себя, а также тренировке в чтении с использованием словаря, умению быстро найти необходимую информацию. Все это должно служить единой конечной цели – научиться свободно читать понимать иностранный текст по специальности.

Свободное, зрелое чтение предусматривает формирование умений вычленять спорные смысловые блоки в читаемом, выделить основные мысли и факты, находить логические связи, исключать избыточную информацию, группировать и объединять выделенные положения по принципу общности, а также формировать навыки языковой догадки на основе контекста, словообразования, интернациональных слов и прочее.

Программой также предусмотрено чтение газетных статей, содержащих общественно – политическую лексику, что должно способствовать тренировке понимания содержания текстов на базе интернациональных слов.

enforceability of such clauses and specifically held that they were applicable to in rem actions…

What [the Supreme Court] establish[ed] was a rule of law which entitles defendants to a dismissal of this action. Such dismissal makes an attachment unavailable.

The court’s refusal to distinguish between a litigant turning its back on the chosen forum, on the one hand, and a litigant going outside that forum for a preliminary attachment, on the other, is regrettable. The Ninth Circuit took the better view when, in the case of Polar Shipping Ltd. v. Oriental Shipping Corporation, it came to the opposite conclusion. There the owner of a ship filed an action in the U.S. for a maritime attachment of property belonging to the ship’s charterer, claiming breach of the charter agreement. The trial court vacated its initial grant of a writ of foreign attachment due to the fact that the charter agreement between the parties contained a clause designating the courts of England as the exclusive forum. The Court of Appeals properly reinstated the writ on the ground that, absent an expression of intent to the contrary, a forum selection clause should not be construed as automatically precluding a party from seeking a prejudgment attachment in a different court.

The view expressed in Polar Shipping has been the longstanding position of the U.K. courts. In the leading case of Mike Trading & Transport Ltd. v. R. Pagnan & Fratelli (The Lisboa), a vessel called The Lisboa, which had broken down en route from Argentina to Italy with a large cargo of wheat, was towed to Tunisia and from there to its destination in Italy. The owners of the cargo, liable for large towage expenses, brought an action in Venice against the vessel’s owners and secured its arrest, disregarding the requirement in the bill of lading that all legal proceedings be brought in London.

Text 1 The decision is striking in still another respect: it enabled the government of Haiti to obtain provisional relief far in excess of the scope of relief that the French court hearing the main action would have granted if the request (to be) addressed to it. The principal decision of the Lords (to be) Siskina v. Distos Compania Naviera S.A. (The Siskina).108 The Siskina was a vessel owned by Panamanian company but managed in Piraeus, Greece. When the vessel was about to enter the Suez Canal en route from Italy to Saudi Arabia, loaded with $ 5 million in cargo, the shipowner (to order) that the ship turn back and unload the cargo in Cyprus on the ground that the Italian charterers of the ship (to fail) to pay the full freight owed under the charter agreement. The shipowners asserted a lien on the discharged cargo for the unpaid freight, and (to bring) an action in the courts of Cyprus. While en route back to Greece, the vessel sank in Greek waters, whereupon the shipowner (to file) a $ 700,000 claim against its London insurer. Meanwhile, the cargo owners in Saudi Arabia, having brought an action in Genoa against the shipowner for damages for the arrest of the cargo (pursuant to a clause in the bill of landing designating

Text 2 One of the few U.S. decisions to address the issue squarely is Sanko Steamship Co. v. Newfoundland Refining Co., Ltd. In Sanko, a shipping company brought suit for breach of a charter party agreement and, in that connection, (to seek) to attach certain New York bank balances claimed to be owed to the defendants. The defendants moved to dismiss the underlying action on the basis of the parties’ prior choice of England as the exclusive forum for resolution of their disputes (citing the Supreme Court decision in The Bremen v. Zapata Off-Shore Co., which essentially (to uphold) the validity of international choice of forum clauses), and also (to oppose) the grant of the attachment. The spread of new communication technologies has revealed an urgent need for transnational harmonization of copyright protection. Despite considerable efforts of international bodies like the European Union and WIPO, the scope of the protection awarded still varies considerably from one country to another. Confronted with this legal diversity and the technical ease for infringement offered by digital media, copyright holders may be reluctant to make protected material available on-line.

The argument developed in this article offers such copyright holders an alternative to a “wait and see” strategy. It has been argued that they can rely on the making of a binding contract with potential infringers willing to acquire the copyrighted works on-line. Such an agreement would provide sufficient protection against infringement, as well as constitute the foundation for acquiring royalties.

To achieve this contract-based enforcement regime, it is first important to isolate the participants to this kind of electronic commerce.

An analysis of the state of technology reveals that the on-line provider of information can already benefit from the opportunity to secure the identification of users before any digital transmission occurs.

It has then been subsequently shown how an exchange of promises of “delivery versus payment” could acquire a legally binding effect through a standard offer and acceptance mechanism. A deeper analysis of the relationships taking place on international digital networks illustrates how to develop a licensing scheme, which can prove effective whether the information is subject to copyright (“copyright license”) or not (“delivery contract”).

In light of the advantages of such a construction, it has been shown that, at least in the United States, the use of contractual schemes to protect copyrighted material may be problematic in the light of the preemption doctrine. However, recent case law tends to affirm the validity of such private agreements, even if their content favors the licensor to the detriment of the licensee. Nevertheless, even without the extensive rights conferred y contracts, copyright holders are not deprived of all protection on digital networks. In particular, American law gives copyright holders the exclusive right to authorize any fixation of the work, even for ephemeral copies that only take place in a computer’s temporary memory.

Not surprisingly, repatriation has also emerged in the practice of the U.K. courts. The later phases of the Derby case, discussed earlier, provide an excellent example. At one point in that litigation, the plaintiffs joined six additional individuals and companies as defendants on account of their roles in the alleged conspiracy, and obtained world-wide Mareva injunctions against them as well. The plaintiffs also prevailed upon the court to appoint a receiver of the assets to the added defendants. The receiver, in turn, sought and obtained from the court ex parte injunctions prohibiting the added defendants from removing assets held in accounts in Brussels, Paris, Dusseldorf, Toronto, Luxembourg, and New York from these jurisdictions. These injunctions were subsequently reinforced by orders of the courts of the respective countries.

As had occurred earlier in the case, the receiver then sought to have these ex parte injunctions extended to the time of judgment. The question arose as to what should happen when the assets in these various countries reached maturity. One possibility (urged upon the court by the defendants) was for these assets to be returned to Switzerland, that being the place where most of the assets of the added defendants were then located. Another possibility was for these assets (and perhaps also the assets of the defendants that were already located in Switzerland) to be ordered transferred out of Switzerland to another jurisdiction (including, presumably, the U.K.). A reason for issuing such an order would be that the Swiss courts were unlikely to recognize or enforce a judgment that the U.K. court might ultimately render against the defendants, and that they might even permit the relitigation in Switzerland of all the underlying issues.

In the end, the chancery judge declined to release the assets located outside Switzerland from the Mareva injunction so as to enable them to be transferred to Switzerland upon maturity. At the same time, however, he refused to order that the receivership assets then in Switzerland, or in any of the other countries where they were located, be transferred elsewhere (including the U.K.). Both parties appealed, and the court of Appeal affirmed. Dillon, L.J., began by reiterating that U.K. courts may, in appropriate circumstances, issue world-wide Mareva injunctions, and may even fortify them by appointing a receiver

Text 1 The old tension between author’s rights and the free flow of ideas has resurfaced with the rise of digital communication. The protection afforded by current intellectual property laws is being strongly challenged by the new ease with which users can reproduce and disseminate protected works without regular monitoring from the copyright owners. At the same time, authors may gain considerable benefits from the increased use of digital networks throughout the world: their works can now be made available to a large, international audience at a relatively low cost, without the help of professional publishers and marketing agencies.

Nevertheless, many copyright owners are still reluctant to invest heavily in the on-line distribution of their works. The potential gains have not yet been able to outweigh the numerous uncertainties still inherent in the legal regime applicable to digital networks.5 This is not so surprising given current challenges to the applicability of all existing law in a purely electronic world.

Text 2: Indeed, even if the American approach is technically correct, since each storage, even temporary, creates a new and perfectly identical copy of the information, it has the consequence of increasing the control of the copyright owner over his work to an extend never reached before. Of course, this can lead to abuses. Further, the opponents to the extension of the reproduction right primarily rely on the analogy with the private use exceptions that have usually been associated with other ‘new’ technologies of reproduction (home copying for VCR and tapes). They also contend that these restrictions to the exclusive reproduction right were not only dictated by the practical impossibility of preventing and tracking infringement, but that they took place also for privacy concerns. Therefore, such restrictions should still play a role in a digital world, even if the enforcement becomes more efficient. In any case, the desirable equilibrium between authors and users would be upset by giving the former the possibility to preclude any user from accessing the copyrighted information.

Text 3: As to whether the Swiss assets should be transferred to another jurisdiction, Lord Justice Dillon assumed that a U.K. court had the power to order such a transfer in an appropriate case. He thought such an order might be justifiable where the assets were located in a jurisdiction that would refuse to enforce an eventual U.K. judgment – at least if it could be shown that the owner’s principal reason for depositing them there had been to insulate them from enforcement. The judge nevertheless considered the request to have been properly denied under the circumstances. As to the transfer of assets then in Switzerland, his rationale was that the parties who were in control of the assets were expected to refuse to transfer them and the Swiss government was not expected to compel them to do so. As to the transfer of assets from banks in Brussels, Paris, Dusseldorf, Toronto, Luxembourg, and New York, he had a different reason for not issuing an order. Based on past experience, he surmised that the courts of those jurisdictions would e prepared to issue their own orders directly enforcing both the Mareva injunction that the U.K. court had already entered and the decisions made by the receiver whom the U.K. court had appointed.

Second, it may also be necessary in cases of transnational provisional relief to distinguish between situations in which a party to foreign litigation seeks relief from a U.S. court and situations in which a foreign court issues its own order of relief and the U.S. court is merely asked (typically by the party in whose favor it was granted) to “enforce” it. The U.S. court may want to treat these situations differently, precisely because in the latter case the foreign court has issued its decree; surely international comity carries greater weight when the foreign court has actually spoken.

Third, discussion of transnational provisional relief often entails some confusion between two distinct questions: whether the court that is asked to intervene by way of provisional relief has jurisdiction to entertain such a request; and whether the application makes out a sufficient case on the merits for granting that relief. Confusion between jurisdiction and merits is much less likely to arise in connection with the more usual forms of international judicial intervention. For example, a court may not even need an independent jurisdictional basis to perform service of documents on a party, though it is very likely to have one. Similarly, a court does not necessarily have to invoke a jurisdictional basis in order to assist a foreign court in the production of evidence – though it certainly will need one in order to compel production. Theoretically, a court may look for a jurisdictional basis to justify enforcing a foreign country judgment, but in practice it will consider the mere presence of assets to be a satisfactory basis. And it goes without saying that, when a court declines jurisdiction in deference to the parties’ prior selection of a foreign forum, or for some other reason, it does not first have to establish a basis of jurisdiction for doing so – though once again, it needs jurisdiction in order to take the further step of compelling a party to submit to the jurisdiction of a foreign court or international arbitral tribunal. In contrast to all these situations, requests for provisional relief seem to invite both a jurisdictional inquiry and (if the result is positive) a determination of the claim for relief on the merits. The distinction between the two may often be difficult to trace, but it is not without significance.

All of there considerations help make the subject of transnational provisional relief a problematic one. The intellectual and practical problems of such relief have not, however, dissuaded parties from requesting it or prevented courts from sometimes raising the prospect on their own motion. As a result, these problems are arising, often enough

Text 1: Another alternative would be for the courts of country Y to entertain requests for provisional relief, but to insist that any such relief take the form of an original protective measure of the court’s own devise. Under this approach, courts would deny requests for enforcement, as such, of measures ordered by a court of country X. Doing so presents a different, but no less serious, disadvantage. Consequently, under the holding of Erie and Hanna, state laws regarding forum selection clauses would be applied in diversity cases. That is, if Ricoh had had a foreign forum designated in its forum selection clause, and the motion had been brought under Rule 12(b) (3), an Erie-based analysis would most likely have led the Ricoh court to conclude that the parochial law of Alabama prohibits the court from enforcing the forum selectionclause. Under an in-depth Erie analysis, the Ricoh court may not have been able to make a convincing argument that the forum selection clause should e upheld. In the event a §1404(a) motion cannot be brought because the forum designated is foreign, the apparent narrowness of the Ricoh holding leaves forum selection clauses vulnerable to parochial state laws.

Granted, a majority of the federal courts have applied federal law where state law should have been applied according to the above analysis. However, the outcome of an Erie analysis regarding forum selection clauses in diversity cases remains far from predictable, as evidenced by a circuit split concerning the issue of whether state or federal law applies to the enforceability of forum selection clauses. While the Second, Ninth, and Eleventh Circuits follow the federal policy of holding forum selection clauses prima facie valid, the Third and Eighth Circuits diverge from this trend.

In the context of a forum selection clause that designates foreign forum, a Rule 12(b)(3) motion to dismiss would not, as discussed above, constitute a federal rule that is controlling pursuant to the Ricoh court’s analysis. Thus, according to Hanna, the outcome-determinative test, guided by the concerns of forum shopping and fairness, must be applied to the issue of the enforceability of forum selection clauses. On the one hand, applying state law in cases brought in diversity would encourage forum shopping among federal courts as long as states differed in their enforcement of forum selection clauses. Applying federal law would, on the other hand, encourage forum shopping between federal and state courts.

Although the application of federal law, as well as that of state law, would both lead to forum shopping, application of federal law would also result in the inequitable administration of the law. The plaintiff would most likely ring suit in a state court with laws most unfavorable to the enforcement of forum selection clauses. By doing so, a resident defendant would be unable to remove the case to a federal court, and the plaintiff would have a unilateral choice in whether to enforce the forum selection clause. In this scenario, both a nonresident defendant, who can remove to federal court, and a nonresident plaintiff would have an advantage over a resident defendant. This kind of “discrimination by noncitizens against citizens”, which makes equal protection of the law impossible, is what the Erie court aimed to avoid.

Obama Addresses Troops at Final Stop in Australia

DARWIN, Australia — Fresh from announcing an expanded American military presence in Australia, a plan that has angered China, President Obama came to this remote northern town that will be the base of operations and told American and Australian troops it is “the perfect place.”

We are deepening our alliance and this is the perfect place to do it,” said Mr. Obama, speaking in a steamy air force hangar to about 2,000 people, mostly Australian troops in green camouflage uniforms but with 55 American Marines salted among them. “This region has some of the busiest sea lanes in the world.”

On Wednesday, Mr. Obama announced that the United States planned to deploy 2,500 Marines in Australia to shore up alliances in Asia, but the move prompted a sharp response from Beijing, which accused Mr. Obama of escalating military tensions in the region.

The agreement with Australia amounts to the first long-term expansion of the American military’s presence in the Pacific since the end of the Vietnam War. It comes despite budget cuts facing the Pentagon and an increasingly worried reaction from Chinese leaders, who have argued that the United States is seeking to encircle China militarily and economically.

“It may not be quite appropriate to intensify and expand military alliances and may not be in the interest of countries within this region,” Liu Weimin, a Foreign Ministry spokesman, said in response to the announcement by Mr. Obama and Prime Minister Julia Gillard of Australia.

In an address to the Australian Parliament on Thursday morning, Mr. Obama said he had “made a deliberate and strategic decision — as a Pacific nation, the United States will play a larger and long-term role in shaping this region and its future.”

The president said the moves were not intended to isolate China, but they were an unmistakable sign that the United States had grown warier of its intentions.

China has invested heavily in military modernization and has begun to deploy long-range aircraft and a more able deep-sea naval force, and it has asserted territorial claims to disputed islands that would give it broad sway over oil and gas rights in the East and South China Seas.

While the new military commitment is relatively modest, Mr. Obama has promoted it as the cornerstone of a strategy to confront more directly the challenge posed by China’s rapid advance as an economic and military power. He has also made some progress in creating a new Pacific free-trade zone that would give America’s free-market allies in the region some trading privileges that do not immediately extend to China.

Mr. Obama described the deployment as responding to the wishes of democratic allies in the region, from Japan to India. Some allies have expressed concerns that the United States, facing war fatigue and a slackened economy, will cede its leadership role to China.

The president said budget-cutting in Washington — and the inevitable squeeze on military spending — would not inhibit his ability to follow through. Defense cuts “will not — I repeat, will not — come at the expense of the Asia-Pacific,” he said.

Some analysts in China and elsewhere say they fear that the moves could backfire, risking a cold war-style standoff with China.

“I don’t think they’re going to be very happy,” said Mark Valencia, a Hawaii-based senior researcher at the National Bureau of Asian Research, who said the new policy was months in the making. “I’m not optimistic in the long run as to how this is going to wind up.”

The United States will not build new bases on the continent, but will use Australian facilities instead. Mr. Obama said that Marines would rotate through for joint training and exercises with Australians, and the American Air Force would have increased access to airfields in the nation’s Northern Territory.

“We’re going to be in a position to more effectively strengthen the security of both of our nations and this region,” he said.
